Member Content Submission Terms and Conditions

Acceptance of Terms

By uploading or submitting any content to the Church Wellesley Village BIA platform (the "Platform"), you (the "User") acknowledge and agree to be bound by these Terms and Conditions. If you do not agree, you must not upload or submit content.

Authority to Represent Business

By proceeding with the upload of content on behalf of the business you represent, you hereby affirm and warrant that you have the full legal right, power, and authority to:

  • Act on behalf of and bind the business you are representing to these Terms and Conditions.

  • Submit and authorize the use of the uploaded content in connection with the Church Wellesley Village BIA website and its related activities.

  • Agree to the indemnification obligations outlined below on behalf of the business.

You understand and agree that by uploading content, the business you represent assumes full responsibility for the legality, appropriateness, and consequences of the content, and agrees to indemnify and hold harmless the Church Wellesley Village BIA, TABIA, and the City of Toronto from any resulting claims, demands, or liabilities

By uploading content (including but not limited to text, images, graphics, audio, and videos) to the Platform, you represent and warrant the following:

  • You are the sole and exclusive owner of all rights, title, and interest in and to the content you upload, or you have obtained all necessary licenses, permissions, and consents from the rightful owner(s) to use, reproduce, distribute, display, and transmit the content as contemplated by the Platform.

  • The content you upload does not infringe upon or violate the copyright, trademark, privacy rights, publicity rights, or any other intellectual property or proprietary rights of any third party.

  • Where applicable, you have provided proper and accurate attribution for any third-party content you are authorized to use.

You agree to indemnify and hold harmless the Church Wellesley Village BIA, TABIA, the City of Toronto, and their respective directors, officers, employees, and agents from and against any and all claims, demands, actions, causes of action, losses, damages, judgments, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Any breach of the above representations and warranties, or

  • Any claim of infringement or violation of any third party's rights in the content you upload

Intellectual Property and Content Ownership

I Community Conduct and Content Standards

By using the Platform, you agree to foster a respectful, inclusive, and professional environment. Specifically, you agree that:

  • You will not post any content that is abusive, harassing, threatening, defamatory, libelous, vulgar, obscene, or otherwise offensive.

  • You will not post any content that discriminates against, promotes discrimination of, or demeans individuals or groups based on race, ethnicity, nationality, gender, gender identity, sexual orientation, religion, age, disability, or any other protected characteristic.

  • You will not post content that is false, misleading, fraudulent, or deceptive.

  • You will not post content promoting illegal activities, hate speech, or violence.

  • You will not use the Platform to engage in commercial activities unrelated to your business or the Church Wellesley Village BIA community (e.g., spam, unrelated promotions).

  • You will respect the diversity of the Church Wellesley Village community, including its rich LGBTQ2S+ history and identity, and contribute to a welcoming environment for all individuals.

  • The Church Wellesley Village BIA reserves the right, at its sole discretion, to remove any content that it deems to violate these standards or to be otherwise inappropriate.

  • Repeated or serious violations may result in the suspension or permanent removal of posting privileges, at the sole discretion of the Church Wellesley Village BIA.

General Disclaimer

The Church Wellesley Village BIA does not pre-screen content posted by Users and does not guarantee the accuracy, integrity, or quality of such content.
All content posted reflects the views of the User and not necessarily those of the Church Wellesley Village BIA, TABIA, or the City of Toronto.

The Church Wellesley Village BIA reserves the right, but has no obligation, to monitor, edit, or remove content for any reason, without prior notice.

Modification of Terms

The Church Wellesley Village BIA reserves the right to update, modify, or revise these Terms and Conditions at any time, without notice.
Your continued use of the Platform after any changes indicates your acceptance of the revised Terms and Conditions.
It is your responsibility to regularly review these Terms and Conditions to stay informed of any updates.
